Whole life tariff
« on: February 04, 2011, 02:55:PM »
When Jeremy was convicted in 1986 he was sentenced to life in prison with a recommendation that he serve at least 25 years. If he had been released after 25 years he would probably be out by now.

In 1994 the Home Secretary, Michael Howard, decided that he would not be released - ever.

Jeremy appealed against that decision in 2004 and lost.

I thought that the Home Secretary lost his power to increase sentences in 2002, or around then.

Have I misunderstood the law?

If people want to see Jeremy out of prison, wouldn't they be better off challenging the ruling of the Home Secretary? If they succeeded in that he'd be out.

I think he's applied to the European Court, and a decision was 'imminent' recently. Maybe it's been delayed on account of the CCRC decision announcement. I understand Jeremy wants a retrial- maybe harder work but he wants to prove his innocence, rather than getting released from 'doing his time'. That's just my opinion and my take on it

Risky though. He could be found guilty all over again.
