CCRC ended?
« on: May 18, 2012, 08:52:PM »
Has the CCRC route of appeal finished. Its going to Judicial Revue as i understand,so is this aspect beyond the control of the CCRC? That is has the case been bumped to the next part of the appeal stage or the end of the CCRC stage. sorry if the question is convoluted but the answer needs to be accurate
many thanks in advance.

The CCRC has made what it hopes is its final decision, but that decision is now being challenged via JR in the High Court. If the challenge is successful the CCRC will have to take the decision again, in light of the High Court's findings. That does not mean that the decision will be reversed, but it could be, depending on what if any faults the High Court find with the decision making process.

CCRC could have reviewed the matter without the need for it to go to judicial review, and appointed a different set of commissioners to look at the case, and make a new final decision, but they appear to have chosen not to, at least for the time being...

Correct. I imagine they are confident of success at the JR.

The CCRC have made a final decision, but it is still open to them to review it.

It takes hours to get locked up and a thousand years to get out of prison. If I were JB I would tunnel through to the chap in the cell next door and when the chap next door dies take his place and get out in a coffin. It's his only chance. Well it worked for the Count of Monte Christo. Then all he has to do is find some treasure on an island somewhere then carry out his well planned revenge on his enemies. Just like the count did. Ok so I'm off on one of my fantasy trips again.

Yep. This.

They were asked if they wish to review their decision, they thought it over and decided no. They are certian enough that the decision was correct and that the JR will fall in their favour.

Hi mat :) If they know that, then surely this is not right, for if it is then no one is doing their homework and abiding by the law....It can't be as clear cut as that?

The CCRC can't possibly know the outcome, before is has been agreed. :)

What are they supposed to do, re-review their decision every time JB says he doesn't like it, which will be any decision which is not to refer?

They will have been told the basis of the JR application in the letter from Simon McKay, clearly they think they will be successful in defending whatever points he has raised.

The CCRC are confident.  Simon McKay knows that MOJ's are not easily overturned.  He took over with limited time to spare.  If the JR is rejected, then I think Mckay will take full control of future submissions, as opposed to having picked up the various threads this time.  He will have to start from scratch in one sense.  Bottom of the pile.  Personally I do not believe that the CCRC have properly investigated what has been brought before them over the nine years.
