Can Public Interest Immunity be challenged in Europe for validity ?
just found thishttp://www.youtube.com/watch?v=Bocwzw3ZYf8
I am still amazed at these film makers who state categorically that they are not taking sides and then go on the state only one side of the story without actually questioning if there is another side. If they think he's guilty why don't they simply come out and say it and not take us for fools by saying they are neutral?
+100 lets work on making it happen, you legal eagles have an opportunity to swoop. The State is not affected here under the Official Secrets Act so what possible reason do the Crown hide behind this other than showing them up as liars !
I know jb was under surveillance after the murders, but this is the first i have heard that he was under surveillance before them and at the time of them.
It should not be allowed on here in my opinion !! Factually incorrect !
Do jeremys defence have paperwork regarding the issue of jb under surveilance on the night of the shootings?i ask here because the thread has been locked.
Who's the film about? cant access it on here.
The short answer is yes, ultimately it could. All domestic remedies have to be exhausted first so it would be necessary to challenge the PII claim in the High Court, then if necessary in the Court of Appeal and the Supreme Court. An important point to remember here however is that if the CCRC did their job properly there would be no need to challenge PII in court as under section 17 of the Criminal Appeal Act the CCRC can demand evidence and defeat a PII claim.
Position of bullet cases mostly Roch !!
Is it a journo vid about this case?
Neil, is there a reason why the defence have not challenged in a higher british court? Since it seems such a huge issue in this case, why have remedies not been sought via these courts?
Someone called Daddyscaff !!
