You post as if you were there??? The point is that no one knows what happened between JB leaving and the police entry. I have said it before and I will say it again. All manner of movement by the adults is possible so you can make up whatever scenario you like about what happened in this time frame. Movement of telephones etc. Even the police do not have a minute by minute record of who did what to who and when. The police can come up with a rough idea but if the police made changes to the crime scene then however much we speculate we are unlikely to work out exactly what happened.
This is one reason for the Aga MARKS to be examined.
Before the supposed Aga burn marks can mean anything, someone has to prove police moved Neville from the Aga to the chair, why they did it, when, how many officers were involved, and why it appears nowhere in the records or POLICE/raid team statements.
Speculation of movement doesn’t remove the burden of proof, the burden of proof has now shifted from the Prosecution, it now becomes the Defence who has to show the conviction is unsafe, and the CCRC don’t work on speculation, they have to be satisfied that there a real possibility the Court of Appeal would overturn the conviction?
At trial the prosecution had to prove guilt, post conviction it is not required to answer speculative suggestions unless the defence can produce new evidence, such as proof that police moved Neville from the Aga and capable of showing the verdict is unsafe.
