Title: What Happens Next
Post by: Newbury1 on April 06, 2011, 02:31:PM
Following the CCRC's decision on 11 February 2011, the CCRC gave JB and his legal team a further three months to respond to their comments (and, I believe, add any new evidence).

We are about a month away for JB and his legal team to submit that response.

Following JB's legal teams submission say on or before 11 May 2011, does anyone know what happens after that and how long it will take for the CCRC to respond?

If he wins an Appeal are we all up for a pint at Goldhanger  ;) ?

JB has said that there will be a lot of material submitted to the CCRC in response to their document outlining the reasons for their provisional decision not to refer the case again to the Court of Appeal. This material will include additional scientific evidence.  In addition from what Mike Tesko has said there is completely new material which JB's team are intending to present.  In view of this I suspect that the CCRC will take several months to make their final decision.

No to meeting JB, but it would be interesting to meet some of the forum and exchange views over a drink.

I don't post as much now as I'm suffering from guilty/not guilty burn out, but continue to enjoy the interesting points of view.

However I think a meet is still some way off, unless Mike comments about a "conversation" between the police and SC exists. Unfortunately, we have been down the carrot dangling path before  ::)

I guess the several months is right, but if Mike's comment's on the thread "Alive alive O - documentary and audio evidence" are to be believed the CCRC will have to or could react a lot earlier.

Great suggestion to all meet up.
Pub in Goldhanger looks great. I,m sure the landlord has some good tales. He may even crack the case, although I doubt it. Would be nice to see you lot, as I can say what I think without a smite.
I agree with grahame on this as we all have an opinion and this smiting is c***.
Hartley has got loads of smites, yet he talks a lot of sense. Smite me I don,t care.

Not that I wish to sterotype myself, but I do live in Essex - Rayleigh - so about 40 mins drive from Goldhanger (depending on my mood  :).  Often drive that way if I go to Colchester as I like to go scenic route.  It is lovely round there.

Yes we could.  Do you, or anyone on this forum, discuss this case with anyone outside of this forum?  Just wondered as I feel bit shy of doing so.

Great your still in Essex, you can teach us all the protocol lol. We don't want to stray into any dodgy areas! Maybe I should start watching "The Only Way is Essex" lol

I discuss it with my husband sometimes but that is it. I don't post on any other forums. Funny thing is I know a lot of people criticize Mike but I honestly believe he protects the people who post on this site.

It's only a small pub. But I should think the landlord will welcome you. Not sure if its the same landlord at the time of the tragedy? But I think he believed JB was innocent?

Blimey, even I don't watch 'The Only Way is Essex' - makes me cringe.  We're not all like that, honest!  Essex is a funny place in a way, bit like a north and south divide within the county.  I think I'm an 'inbetweeny'.

I agree about Mike, it's a great forum.  He lets people say their piece and welcomes debate, and he has a lot of patience as all these topics have been debated over and over  - we're going round in circles...

Probably not Grahame but I can imagine us having a good night and we could discuss things a lot quicker face to face.

I'm sure I've read somewhere (can't remember where) that the landlord at the time said JB was a model customer.

Strangely enough I googled that pub today and they've got a great new food menu!

Even though I am such a noob and not in England to boot, I invite myself! I can always use an excuse to lure my partner to go to England with me... We went twice, but he tends to want to travel elsewhere. I always want to go to England! Just love it!
The scenery in Essex is beautiful and the pub looks so cosy...

On a more serious note, I hope the Bamber case will be reviewed. There are too many unclear points - that is why people are still pondering it, isn´t it!

I used to live near Barnsley but moved to Newcastle 20 years ago. I could pick you up on the way down Andrea! lol  :D

Takeshi, you're practically my next door neighbour...

I know! That is why I posted that stuff for you about "the torso in the tank murder". I found it quite interesting myself since it was just across the water Hadn't heard of it until you made your post  :)

I think there should be a re-trial, so that all the evidence can be looked at more completely and all the inconsistencies ironed out, and considered by a new jury - the reputation of the criminal justice system is at stake. As things stand, the criminal justice system appears to h ave been brought into disrepute by the way this case has been handled and processed through the various courts.....

Mike you tell me though, where the hell are they going to find an unbiased jury today? It is virtually impossible. If he is granted leave to appeal I think it it very unlikely that the result would be a retrial.

I think it's been too long for a retrial. Much of the forensic evidence has been lost, and memories have been dimmed too much.

I agree Kaldin. So there would have to be something very significant put to the CCRC for them to refer to the Court of Appeal because I think they realise a retrial is not viable so anything new would have to warrant an acquittal. Unless the resent appeal for information has unearthed something concrete I can't see that happening.

I agree.  If the CCRC do refer the case to the Court of Appeal, the conviction will either be upheld or overturned, and if it is overturned there will be no retrial, JB will be found not guilty.  The key question is, will the CCRC refer the case for a second time?  They will be very careful about doing this because the 2002 appeal went overwhelmingly against JB.  The CCRC referred the case then on one ground only (the DNA/silencer evidence), but as was their right JB's team relied upon a series of grounds of appeal.  Each one was rejected and the Court of Appeal went further than is normal or than was necessary in stating that they were in complete agreement with the verdict of the jury.  The CCRC will inevitably have this in mind in considering the latest submissions on behalf of JB.  I suspect they will need some powerful new evidence, not available at trial, to risk their reputation on a second referral.  If they do make a referral on a single ground it will still be open to JB's team to rely upon other grounds, including ones which have been argued before.  The position currently does not look very promising for JB in view of the provisional decision of the CCRC not to refer the case back to the Court of Appeal.  Mike Tesko has strongly suggested that there is new evidence which has come to light recently.  If this is credible evidence which seriously undermines a key aspect of the prosecution's case at trial the position for JB will be far more positive.  However the latest posting on Jeremy's "official" website does not give the impression that there has been any dramatic new development since the CCRC announced their provisional decision.  We should perhaps not read too much into that, although if there has been a major breakthrough I can see no reason for JB's team not to make that public, as they did with the Peter Suthurst report.  Whatever the position, I suspect that we will have a long wait until we hear the final decision of the CCRC.
