Calling NGB1066
« on: March 23, 2012, 04:00:PM »
When the ECHR challenge was made against the Life sentencing tariffs, using multiple cases, is it possible to use the same tactic in relation to MOJ, possibly with Bamber, Gilfoyle and Hall. Costs are always used as reasons why appeals are held like they are, but if for example " No Time Of Death " and other points that crop up like " Unsafe Forensic Evidence " for instance. Because it would be held in one Appeal Court the Costs would be at least half as much as three separate Appeals and the safety or failure of evidence could be assessed through Comparison and not just an Experts opinion. Remember X is an unknown quantity and Spurt is a small drip. All of the MOJ's have involvement of so called Experts on the side of the Prosecuter !!!!!!!!

Campion - occasionally the Court of Appeal does hear several appeals together.  This is done not so much as a cost saving exercise (although obviously it does same a substantial amount) but in order that cases raising identical points of law or turning upon the same expert evidence can be considered together with all parties presenting their arguments to the same court.

In the Bamber case although there are similarities with other cases that you mention, in my view the issues are not sufficiently in line with the other cases to justify hearing the appeals together.

I might have worded it wrong NGB, its not just the appeals. With the coverage of MOJ's by Williams Thomas on tv, if it is highlighted that the Police use various methods of deviousness to gain these unsafe convictions, a legal challenge could be made separate to an individual appeal, but incorparating three cases to test the legal argument. These MOJ profiles are going to be elevated by the awareness gained from tv coverage. The actual programmes can't be that expensive to make, they are compelling viewing because of the content and mistrust with the Public's perception of skulduggery regarding Leveson, Weeting, etc. Surely the time to hammer home a message is when Public Interest is high, and raise the profile of other cases. Capturing the moment so to speak.

Campion - Yes, I see your point and I agree with you.  There are common themes running through many MOJ cases and the more that can be done to raise public awareness of these the better.  Quality documentaries, as I expect the Mark Williams-Thomas one on ITV next week will be, help to generate public interest and that is very positive.

No, he is the presenter and he conducted the interviews.  He has considerable input into the production.

Lets not underestimate what your involved in regarding Bamber. The word difficult comes to mind, Bamber makes legal history if his team get a third appeal, winning it is a different story altogether. I want you to Win although there do seem to be almost impossible odds stacked against this happening.
My awareness to MOJ's was non existent to be honest, I had allsorts of things taking up my time before Bambers case was pointed out. Since then Eddie Gilfoyle, Simon Hall and The Cardiff Three have come up. I can't be in a minority of one and unless this current interest isn't expanded on then other stuff like the Olympics will suffocate it !

I have forgotten his name.  Vic knows and I believe he posted the name here two or three weeks ago.

Edit: I have found Vidvic's post.  He says the producer is Dave Radings.
