Yes,that was Marion O'sullivan who was with her partner nugnug,they saw someone near to the entrance to RDP just before 6'00 and said it definately wasn't Luke.Altkough I see it says driveway.But as you say,in the same area as the alleged F/W sighting.Probably the same person.

I think this was decided by Findlay towards the end of the trial for some reason Steve.

The defence possibly thought on balance it would do more harm than good.

I really dont know why Findlay made the decision not to call Luke to the stand or how commom a practice this is Steve.As you say,maybe Findlay thought he was winning at that time and didn't want to risk damaging the situation.Not sure if Findlay has given an interview about the case or not.

It depends on several factors. The figure I have for the USA is 50/50. It's higher in a murder trial if the defendant is claiming self-defence, though obviously that doesn't apply to Luke Mitchell.

I really didn't know about this at all,I just imagined that virtually every defendant gave evidence.This is a surprise to me Steve.So Luke not giving evidence is nothing out of the ordinary then?

Well, a barrister might argue that the prosecution has to prove its case, so err on the side of caution, particularly if a defendant is prone to outbursts. With Kyle Rittenhouse it was regarded as imperative that he gave his side of the story, as he was claiming he acted in self-defence. As far as the Luke Mitchell trial was concerned, the way he treated police officers during interrogation and his obsession with knives and the Devil might have given Findlay cause for concern.

He treated officers Steve? A boy of 14? Interrogation? That would have been in his favour,and was indeed dealt with at his appeal.The knife issue wouldn't have helped though.

Wow! Braggadocio. That is indeed a beauty Steve,as usual I had to look it up to find out the meaning.Anyway, have you read 'Innocents Betrayed' yet,the police bullied him from the start accusing him of killing Jodi over and over till he finally blew his top,they also asked the most intimate and embarrassing questions about what he got up to with Jodi in private.Anyone would have snapped in the end and acted with Braggadocio Steve.Enough is enough,his 'INTERROGATION' as you rightly put it was shamefull and will go down in history as such.
