At night, the shouting starts. When the lights go out at Hindley, the young offenders institute, you can hear the intimidating shout-outs, the insults and threats from other boys kept there. Staff have tried to stop it, but they’ve failed.

The shouting is part of an atmosphere of violence and fear which permeates the institution.  On average, there is one fight or assault every day. There were 251 reports of bullying and 167 incidents of self-harm in six months.

In January 2012, Jake Hardy, a 17-year-old at Hindley, was found hanging in his cell. He was one of 16 children to die in custody since 2000. The inquest into his death detailed a dozen failures by the state which contributed to his death.

A jail in Nottinghamshire where four inmates killed themselves in less than a year has been described as a “prison in crisis” in a damning report.

HMP Ranby was found to be “unsafe” with high levels of violence, the HM Inspectorate of Prisons report said. The situation at the jail near Worksop has “deteriorated significantly” since the last inspection in 2012, it said.

The jail’s governor has taken “decisive action” over the concerns, the National Offender Management Service said.

“This report is troubling and we identified many problems within the prison,” said HMIP, which made 106 recommendations. It said that nearly half of Ranby’s 1,088 inmates felt “unsafe” at some time.

A TEENAGE detainee at Hindley Young Offenders’ Institute was under a special “observation” regime when he was found hanging in his cell, an inquest jury heard.

Jake Hardy, 17, was rushed to hospital but never regained consciousness and died four days later.

The inquest at Bolton is expected to last six weeks and there are half a dozen legal teams attending on behalf of the various state authorities: prison, youth offending and mental health bodies.

Formally opening the inquest, assistant deputy coroner Alison Hewitt revealed that 6ft tall and well built Jake, who suffered from learning difficulties, attention deficit disorder, dyslexia and depression, had registered official complaints of bullying by other detainees.

On the evening of the incident in January 2012, he had refused to come out of his cell for the standard two-hour “association period” between 6pm and 8pm.

That was because, it was stated, he was upset at having been earlier refused the right to call his family at home in Chesterfield, Derbyshire.

Closed circuit television recordings show a number of other detainees “kicking his door” during this period and apparently shouting through the inspection window to him. However it did not record what they were saying or the manner being used.

Hardy, who also had a history of self-harm and smashing up furniture and even a television to cut himself, was under a “every 30 minutes” watch system known within the service as ACCT specifically because the authorities had concerns about his behaviour,

A night duty YOI officer checked him at 8.43pm and found Hardy sitting at the desk with the cell light on and apparently calm and composed.

But 25 minutes later, when he was checked again, the cell light was extinguished.

He shone a torch through the inspection window in the cell door and could see that Jake was motionless and was suspended from the cell window with a ligature made from a bed sheet.

Staff at the YOI, which takes teenagers from 15 to 18, managed to restart his heart with CPR massage.

But he never regained consciousness and died at Salford Royal Hospital four days later.

Hardy was one of three teenagers to die in Young Offenders Institutions from apparently self inflicted deaths within a ten month period.

Because of national concern about standards of care within the YOI sector, UK charity INQUEST has arranged for the Hardy family to be represented at the hearing by top Queens Counsel, Dexter Dias.

Hardy was less than half way through a four months sentence for assaulting his girlfriend.

However, the couple were still together despite this, the Coroner said.

An investigation into a man’s death in police custody has discovered he was hit with CS spray and pepper spray before he apparently suffocated.

Aamer Anwar, a solicitor acting for the family of Sheku Bayoh, who died in Kirkcaldy, Fife, this month, said the new information could be critical because both sprays had been linked to other deaths in custody.

Bayoh is thought to have died from suffocation or “positional asphyxia” after he was restrained during his arrest by up to nine police officers on Sunday 3 May.

Anwar has told Frank Mulholland, Scotland’s lord advocate, that Bayoh’s family was surprised to discover that the sprays’ use was not mentioned in a preliminary postmortem report, despite expert evidence that they could be a contributory factor in deaths in custody.

Deborah Coles, co-director of the deaths in custody campaign Inquest, said: “We have worked on a disturbing number of restraint-related deaths where the use of CS spray has been one of the contributory factors. The potentially fatal consequences of CS spray and restraint are well documented, and implicit in police training and guidance, informed by previous deaths.”

Experts at the Faculty of Forensic and Legal Medicine recently said suspects hit by CS or pepper spray should not be held down on the ground, to avoid causing breathing problems. “Restraint in the prone position must be avoided after exposure. If restrained, breathing must be monitored constantly,” they said (pdf).

In 2010 a detailed review of deaths in custody by the Independent Police Complaints Commission, the watchdog for England and Wales, highlighted a series of cases where police forces were told to improve training for officers after CS and pepper sprays and physical restraints were linked to deaths in custody.

Anwar said he had pressed Scottish investigators and prosecutors to confirm that the use of CS spray and a type of pepper spray known as PAVA (pelargonic acid vanillylamide), now widely used by UK police forces, was central to their investigation into Bayoh’s death.

Anwar said Scotland’s independent police complaints authority, the Police Investigations and Review Commission (PIRC), had assured him that pathologists had been briefed that the sprays were used, as were batons.

The Bayoh family has hired two leading forensic pathologists, Dr Nat Carey and Prof Anthony Bussitil, to advise them on the case.

“These issues are of critical importance and must be considered by crown pathologists in trying to determine the cause of death,” Anwar said. “The sprays’ role in a case of death in custody cannot be ruled out.”

The confrontation between Bayoh, a gas engineer from Sierra Leone, and the police took place after residents reported seeing a man wielding a knife chasing and kicking out at cars.

Officers arrived in six different vehicles, and there were scuffles during Bayoh’s arrest. Bayoh lost consciousness after being restrained on the pavement with his wrists handcuffed behind his back and his legs tied with restraints.

Anwar said he had been told that Bayoh was hit repeatedly with police batons before being restrained. Officers at the scene tried to resuscitate Bayoh but were unable to do so.

The controversy over Bayoh’s death deepened last week when Peter Watson, a lawyer acting for nine officers and the Scottish Police Federation, claimed that one “petite” female officer involved in initially confronting the suspect had feared for her life after Bayoh allegedly repeatedly hit, kicked and stamped on her.

Those allegations and further claims that the officer was hospitalised with serious injuries because of Bayoh’s violence are disputed. It is understood she suffered one minor blow to the head and was discharged from hospital that day, after an outpatient examination.

Police Scotland later had to deny a rumour that circulated soon after Bayoh’s death became public that she had been stabbed.

The PIRC refused to comment on the ongoing investigation. The Crown Office said Anwar’s concerns about the postmortem report’s omission had been passed on to PIRC investigators.

“We can confirm that we have received correspondence from Mr Anwar on behalf of Mr Bayoh’s family and this has been shared with the PIRC,” a spokesman said. “It would be inappropriate for us to comment further in the course of a live and ongoing inquiry.”

Watson, the police lawyer, would not comment on the latest disclosures. “There can be no comment as this is an active inquiry by PIRC,” he said.

A four-year battle for justice ended in victory as an inquest jury found neglect contributed to the death of Kingsley Burrell.

The 29-year-old suffered a cardiac arrest after being restrained for a prolonged period of time with a towel over his head at the Oleaster Health Unit.

At the conclusion of the five-week inquest it was ruled force used by the police in restraining Kingsley was excessive and contributed to his death.

It also found a covering was placed over the dad’s head as he was transported between A&E at the Queen Elizabeth Hospital and the Oleaster Unit on the same site.

That covering remained on his head even after he had been restrained in a seclusion room.

Jurors founds police, paramedics, A&E staff and staff at the mental health unit should all have removed the covering.

I had a wordpress blog in the past but removed it from the WWW out of respect for the victim & her family https://freesimonhall.wordpress.com/?p=569 - it quite clearly states the author has removed the blog from the WWW.

Below is an Excerpt taken from the malicious blog. In my opinion it's quite chilling - the author appears to be projecting their own behaviours.

"All you do is make friends, make pinky promises with them that you’re going to be friends forever and never tell on each other.  Wait a bit until they tell you things about themselves so you can mix it up when you tell on them (it’s more fun if you make things up :) ).   You might have to tell them some secrets as well just to pretend you are friends and be careful what you say cos it might come back on you…  (I’m too clever for that.)

Call me the spin(ster) doctor! :) :) :)

After that all you do is argue with your friends and start telling lies about your them on the internet, they will hate it and then they will try and fight you but they won’t know who you are because the secret is to change your personalities when they ask you….!

I have been told that some people don’t like trolls and that we hurt people’s feelings but what else do you want me to do?  And to be honest it’s not my problem, I think it’s really funny and I enjoy it."
