That is why it is murder. You have the duty to retreat when you can and to not use force that is disproportionate to the threat you are facing.  Noye was the aggressor he started the altercation by threatening the couple.  The victim got out and was physically attacked by Noye.  Noye threw the first punch.  Noye then tried to find his knife thinking it was in his pocket but it wasn't, it was in his car.  He ran to his car, got it then ran back to stab the victim. He knew he had no viable claim of self-defense that is why he didn't wait for police he fled the scene and then fled the country. 

This is an open and shut case.

Its a long story but this could have been an 'unfair trail' because several years before Noye had killed an undercover policeman and convinced the Jury it was self defence and got away. So the police where hell bent on butting him behind bars even if they had to resort to corruption because he had killed one of their own so to speak. Noye was a notorious gangster after his police murder trial so his second trial for this the public all thought he was guilty. He is suspected of more killings including this one

But these other things have nothing to do with the facts of the murder he was convicted of.

He attacked someone, killed him then fled the scene and country as fast as he could.  How could police have orchestrated it so that he would kill someone like that and then flea?

I don't mean like that.

Noye done it but It all rested on one eyewitness, since he got away with it before they would not let it happen again speciality since he killed a copper

They should make sure he didn't get away with it anyway.  It seems they even suspect him of having killed witnesses and had to put the star witness is witness protection and relocate her. She was pretty brave to face him.

She was the one that travelled with undercover police to Spain to locate and identify him. Without her it would never have been solved
