i've often said on this forum that "you have to think like a judge"
the popular (mis)conception is that judges are old oxbridge fuddy duddies but i can assure you that (certainly, every high court judge that i know) the reverse is true - they are people of great intellect with enormous experience of life and possess independent thought
however, these judges alao possess one simple attribute - "common sense"
and i'm afraid that the "common sense" is all one way in this case
i'll stick my neck out here and now - jb will lose the application next week
that i'm afraid is, so far as i can see, the end of the road
thereafter, he'll need new/fresh evidence and, after more than 27 years, i don't think that that will materialise
