Even if it proved what Boyce claims how does it exonerate JB? It doesn't. How does it meet the CPS criteria for an appeal hearing? It doesn't and the CCRC will not waste resources.
The marks on NB's back were not even used at trial by either the defence or prosecution since neither pathologist was able to say conclusively what they were, how they were caused and when etc. The marks on NB's back could not have formed any part of jurors' decisions.
'Hearing new evidence' needs to be based on something highly pertinent to the trial which had jurors understood at the time might well have altered their decision/verdict.
Well obviously I disagree, Cutie. I think the Aga evidence is indeed new and if given to the CCRC with the correct scenario should have gained JB a refferal.
But if the CT have paired the Aga evidence up with the integrity of the scene, ie, the police moving Nevills body, all that they have achieved is the 'baby being thrown out with the dish water'! Madness!!
The Aga evidence is plain and simple, it is there for all to see and doesn't rely on any conspiracy theory.
All the CT had to do was prove the Aga theory and an innocence JB scenario would follow, it would mean the burns happened much earlier and also meant the killer was in the Whitehouse for a considerable amount of time, probably several hours according to the Boyce experiments, surely this would rule out JB?
